Terms & Conditions
Please read these Terms and Conditions carefully before using https://www.groovelaserdesign.co.nz (“the Site”), operated by Groove DJ Entertainment Limited, trading as Groove Laser Design (“we”, “us”, “our”).
By accessing or using this Site, placing an order, submitting artwork, or purchasing any product or service from us, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you should not use this Site or place an order with us.
These Terms apply to all users of the Site, including customers, browsers, vendors, merchants and contributors of content.
Accuracy, Completeness and Timeliness of Information
We make reasonable efforts to ensure that information on this Site is accurate, complete and current. However, the information on this Site is provided for general information purposes only and may occasionally contain errors, omissions or outdated information.
We reserve the right to update, correct or change the contents of this Site at any time without prior notice. You acknowledge that it is your responsibility to monitor any changes to our Site or Terms.
Products, Custom Orders and Personalised Items
Groove Laser Design provides laser-cut, laser-engraved, personalised and custom-designed products. Some products may be made to order, personalised with names, dates, logos, artwork or other customer-supplied information.
Because many of our products are customised, personalised or manufactured specifically for each order, it is your responsibility to ensure that all details supplied to us are correct before production begins. This includes, but is not limited to:
- spelling of names, dates and wording;
- artwork files, logos and images;
- layout instructions;
- product choices, colours, sizes and material selections;
- delivery details and contact information.
We may refuse, cancel or request changes to any order where the requested design, wording, artwork or content is offensive, unlawful, misleading, defamatory, discriminatory, infringing, technically unsuitable, or otherwise inappropriate at our discretion.
Artwork, Design Proofs and Approval
Some orders may require artwork, design proofs, mock-ups or layout approval before production. Where approval is required, we will provide the customer with a proof or request for approval using the contact details supplied at the time of order.
It is the customer’s responsibility to carefully review all artwork, spelling, layout, sizing, positioning and other details before approving production.
Once artwork is approved, the item may proceed to manufacture. We are not responsible for errors, omissions or changes requested after approval has been given, unless the issue was caused by our own mistake during production.
Artwork Approval Timeframe
Where an order requires artwork approval, the customer must provide approval, requested changes, or clear written instructions within 14 days of the artwork proof or approval request being sent.
If approval or instructions are not received within 14 days, we reserve the right to manufacture the item at our discretion using the artwork, wording, layout and information available to us at the time.
Where we proceed in this way, the customer accepts that production decisions have been made in good faith based on the information provided, and the order will be treated as approved for manufacture.
Delays in artwork approval may also delay production and delivery timeframes.
Customer-Supplied Artwork and Intellectual Property
If you provide us with artwork, logos, images, wording, designs or other content, you confirm that:
- you own the content, or have permission to use it;
- the content does not infringe any copyright, trademark, privacy, publicity or intellectual property rights of any third party;
- the content is not unlawful, offensive, defamatory or misleading;
- we are permitted to use the content for the purpose of fulfilling your order.
You agree to indemnify us against any claim, loss, damage, cost or expense arising from the use of customer-supplied artwork, logos, images, wording or other content.
We may refuse to use artwork or content where we reasonably believe it may infringe third-party rights or breach applicable law.
Colours, Materials and Product Variations
We make every effort to display product colours, finishes, materials and images as accurately as possible. However, colours and finishes may vary depending on screen settings, lighting, natural material differences and production processes.
Natural materials such as wood, plywood, bamboo, leather, acrylic, paper and similar substrates may vary in colour, grain, texture, density, markings and engraving result. These natural variations are not faults.
Laser engraving and cutting may also produce minor variations in depth, darkness, edge finish, kerf, burn marks, smoke marks or positioning. We take reasonable care to produce high-quality results, but small variations are part of the laser manufacturing process.
Pricing and Availability
Prices for our products and services are subject to change without notice.
We reserve the right to modify, discontinue or remove any product or service at any time. Product descriptions, images, specifications, availability and pricing may be updated or changed at our discretion.
We may correct pricing errors, product description errors, availability errors or other mistakes at any time, including after an order has been submitted. If this affects your order, we will contact you using the details provided.
We reserve the right to refuse or cancel any order, including where an item has been incorrectly priced, incorrectly described, unavailable, or where we suspect misuse of the Site or ordering process.
Payment
Orders must be paid in full unless otherwise agreed in writing.
Production may not begin until payment has been received and, where required, artwork has been approved.
If payment is not received, or if a payment is reversed, declined or disputed, we may pause, cancel or withhold the order until payment has been resolved.
Production Timeframes
Any production or turnaround times stated on the Site, by email, by invoice or through any other communication are estimates only unless expressly confirmed in writing.
Production times may vary depending on order complexity, artwork approval, material availability, order volume, courier delays, public holidays or other circumstances beyond our control.
We will make reasonable efforts to complete and dispatch orders within the estimated timeframe, but we are not liable for delays outside our reasonable control.
Delivery and Shipping
Orders may be delivered by courier, post, local delivery, pickup, or another agreed method.
Delivery timeframes are estimates only and may vary depending on the delivery provider, location, weather, public holidays, peak periods or other factors outside our control.
Risk in the goods passes to the customer once the order has been delivered to the address provided, collected by the customer, or handed to the delivery provider, unless otherwise required by law.
It is the customer’s responsibility to provide accurate delivery details. We are not responsible for delays, failed deliveries or loss caused by incorrect or incomplete delivery information supplied by the customer.
If an order arrives damaged, you must contact us as soon as possible and provide clear photos of the packaging and damaged item so we can assess the issue and, where appropriate, assist with a courier claim or remedy.
Returns, Refunds and Cancellations
Your rights under the New Zealand Consumer Guarantees Act and Fair Trading Act are not excluded or limited by these Terms.
Because many Groove Laser Design products are custom-made or personalised, we do not usually accept returns, refunds or exchanges for change-of-mind purchases, incorrect customer-supplied information, approved artwork errors, or personalised items that cannot reasonably be resold.
However, if an item is faulty, damaged, not as described, or does not meet applicable consumer guarantees, please contact us so we can assess the issue and provide an appropriate remedy.
Depending on the circumstances, this may include repair, replacement, refund or another remedy required by New Zealand law.
Order cancellations may not be possible once production has begun, materials have been ordered, artwork has been prepared, or custom work has commenced. Any cancellation request will be considered at our discretion.
Optional Tools and Third-Party Services
We may provide access to third-party tools, apps, payment gateways, courier services, embedded content or external services. These are provided by third parties and may be subject to their own terms, conditions and privacy policies.
We are not responsible for third-party tools or services, and your use of them is at your own risk and discretion.
Third-Party Links
This Site may contain links to third-party websites or services that are not owned or controlled by us.
We are not responsible for examining, evaluating or guaranteeing the content, accuracy, policies, products or services of third-party websites. Any transaction or interaction with a third-party website is solely between you and that third party.
Accuracy of Billing and Account Information
You agree to provide current, complete and accurate purchase, billing, shipping and contact information for all orders.
You agree to promptly update your information where necessary so that we can complete your order, contact you about artwork approval, arrange delivery, and provide customer support.
We reserve the right to refuse, limit or cancel any order where we believe information provided is inaccurate, incomplete, fraudulent, suspicious or otherwise unsuitable.
Personal Information
Your submission of personal information through the Site is governed by our Privacy Policy.
We use customer information for purposes such as processing orders, preparing artwork, communicating with customers, arranging delivery and providing customer support.
Errors, Inaccuracies and Omissions
Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability.
We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information is inaccurate, including after an order has been submitted.
Prohibited Uses
You must not use this Site or our services:
- for any unlawful purpose;
- to solicit others to perform or participate in unlawful acts;
- to violate any applicable laws, regulations or ordinances;
- to infringe our intellectual property rights or the intellectual property rights of others;
- to submit false, misleading or fraudulent information;
- to upload or transmit viruses, malware or malicious code;
- to spam, phish, scrape, crawl or interfere with the Site;
- to harass, abuse, defame, threaten, intimidate or discriminate against others;
- to submit obscene, offensive, hateful or otherwise inappropriate content;
- to interfere with or circumvent the security features of the Site or any related service.
We reserve the right to terminate or restrict your access to the Site or our services if you breach these Terms.
Disclaimer of Warranties and Limitation of Liability
We do not guarantee that the Site will be uninterrupted, timely, secure or error-free.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, loss of revenue, loss of data, business interruption or replacement costs arising from your use of the Site, our services or products purchased from us.
Nothing in these Terms limits or excludes any rights or remedies that cannot be excluded under New Zealand law, including applicable rights under the Consumer Guarantees Act and Fair Trading Act.
Where we are legally permitted to limit our liability, our liability will be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Groove DJ Entertainment Limited, trading as Groove Laser Design, and our directors, employees, contractors, suppliers, service providers and affiliates from any claim, demand, loss, damage, liability or expense arising from:
- your breach of these Terms;
- your misuse of the Site;
- your violation of any law;
- your infringement of any third-party rights;
- your submission of artwork, logos, images, wording or other content that you did not have permission to use.
Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed from these Terms to the extent necessary. The remaining provisions will continue to be valid and enforceable.
Termination
These Terms remain effective unless terminated by either you or us.
You may stop using our Site or services at any time. We may terminate or restrict your access to the Site or our services if we believe you have breached these Terms or used the Site inappropriately.
Any obligations or liabilities incurred before termination will survive termination.
Entire Agreement
These Terms, together with any policies or operating rules posted on this Site, constitute the entire agreement between you and us regarding your use of the Site and purchase of our products or services.
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Governing Law
These Terms and any separate agreements whereby we provide products or services to you are governed by and interpreted in accordance with the laws of New Zealand.
Changes to These Terms
We reserve the right to update, change or replace any part of these Terms by posting updates on our Site.
It is your responsibility to check this page periodically for changes. Your continued use of the Site or our services after changes are posted constitutes acceptance of those changes.
